摘要
在人工智能飞速发展及其对人类社会影响不断深化的背景下,人工智能的风险规制成为需要解决的重要问题。人工智能及其研究开发的主要特征决定了相应风险具有不可知性、多样性、变动性等属性。传统规制的僵化与失灵无法因应人工智能的前述属性,从而陷入规制困境。而实验型规制不仅可以回应风险规制的多重困境,亦能最大限度地保障人工智能的自由发展,因此是人工智能风险规制的可行出路。
Artificial intelligence risk is potential possibility about negative consequence on health,security and living environment caused by new technology or brand new products,which can replace the traditional relevant products.In order to regulate it,the problems on information insufficiency and regulation resistance should be solved.Beforehand preventing mode and compensation mode of traditional risk regulation cannot deal with these problems so that the experimental mode would play an important role in emerging risk regulation.
