影响中国高铁“走出去”的知识产权风险因素分析 被引量:6

摘要 中国高铁"走出去"作为"一带一路"倡议与"交通强国"战略实现的重要载体,其中的知识产权问题关乎国家安全与产业安全,知识产权风险因素的有效识别与体系建构具有迫切的理论与现实意义。本文立足于过程理论及知识产权风险相关理论并结合产业实践,实现对高铁"走出去"中四类知识产权风险因素的概念化、因子化、体系化,运用解释结构模型方法构建了知识产权风险因子间的相互关系与结构体系。研究发现,高铁知识产权风险因素结构体系由19个因子构成,分为知识产权权利、权利行使与执法、权利救济三个层次,分属于基础性、高发性和救济性知识产权风险,各因子间具有相应的影响关系。最后,针对研究发现提出面向政府决策、产业发展和创新主体知识产权管理策略的系统性对策,实现高铁"走出去"的知识产权风险识别与预警。 China’s high-speed rail export has already become the most important carrier of One Belt One Road initiative and Traffic Power Strategy for China. The intellectual property issues in this process matters both national security and industry security. The effective identification and system construction of IP risk factors are not only theoretical but also practical issues. Based on the existing process theory and IP risk theory and considering the industry practice, this research has realized the conceptualization, factorization and systemization of IP risks by using Interpretive Structural Modeling. We find that the system is constructed with 19 factors which can be categorized into 3 hierarchies namely IP rights, exercise of rights and enforcement, right relief, which respectively correspond to basic, high-incidence and relief IP risk categories between which there are mutual effects. Finally, some systematical countermeasures towards government decision making, industry development and innovators’ IP management strategy have been raised according to the findings.
