摘要
生态文明战略目标的实现需要公众的广泛参与。福建省在生态文明建设中,积极探索并推进公众参与的法制建设,但仍存在公众参与法律机制不健全、具体制度操作性差等诸多问题。通过对福建省公众参与生态文明法制建设的实践分析,正视公众参与所面临的法律困境,并基于公众参与法律机制的构成要素提出相应的法律对策,切实保障公众全程参与立法-执法-司法的权利。
Extensive public engagement is required to realize the strategic goals concerning ecological civilization.During the ecological civilization construction process in Fujian Province,the legal mechanism with public engagement has been promoted and advanced.However,there still exist many issues such as unsound public engagement in legal mechanism,poor operability of the mechanism,and so on.In this paper,existing issues have been analyzed based on the real practice of public engagement in ecological civilization legal mechanism construction in Fujian Province.Furthermore,corresponding suggestions have been put forward based on five elements of public participation in the legal mechanism,ensuring the public 's participation in legislation throughout the whole process of law.
