摘要
我国在环境立法中应明确环境公众参与主体应为“公众”;对环境公众参与的范围应确立广泛性原则、环境决策参与为核心原则和以对环境有重大影响为主原则的三项原则,让与环境有关的一切事务,都有公众的声音;对环境公众参与的方式应采用多样化,具体运用以追求公平兼顾效率为原则。
the legal term ＂public＂ as the subject of the public participation in environmental protection in Chinese environment laws. Extensiveness, participation decision of the core, great influence on environment should be set as prineipIes for the scope of the public participation. All those on environment should have a voice of the public. The methods of public participation require variety of the methods in order to have a balance between efficiency and equity.
