摘要
林业碳汇权作为新型财产权利,具有可交易性与适质性,具备质押融资的可行性条件。以其设质有利于林业碳汇项目顺利开展,促进碳交易市场健康发展,也有利于推动绿色信贷,构建绿色金融体系。林业碳汇权设立质权不仅在理论上可行,也是现实之需,应明确林业碳汇权的法律地位,从出质人及其责任、质权实现时间和方式以及质权登记与公示方面完善林业碳汇权质押融资的法律制度。
As a new type of property right, forestry carbon sink right is tradable and suitable, and has the feasibility conditions for pledge financing.It is conducive to the smooth development of forestry carbon sink projects, promotes the healthy development of the carbon trading market, and promotes green credit and builds a green financial system.The establishment of pledge rights for forestry carbon sink right is not only theoretically feasible, but also a realistic need.The legal status of forestry carbon sink right should be clarified.It is necessary to improve the legal system of forestry carbon credit pledge financing from the pledgor and its responsibilities, the time and method of pledge implementation, and the registration and publicity of pledge rights.
