摘要
劳工标准在保护劳工合法权益的同时,也会影响东道国对外商直接投资的吸引力。本文基于43个"一带一路"沿线国家2006—2015年的样本,考察东道国劳工标准对中国OFDI的影响。研究发现,劳工标准不仅直接影响中国OFDI,还会通过双边投资协定和东道国制度环境间接影响中国OFDI,表现为双边投资协定中包含劳工标准条款仅对中国向"一带一路"沿线发达国家投资有显著影响,对新兴工业化国家和发展中国家则不显著,并且与中国签订双边投资协定(或双边投资协定中包含劳工标准条款)的东道国随着制度质量的提升,有更强的保护本国劳工权益的偏好,这在新兴工业化国家体现得最为明显。进一步研究表明不同经济发展水平东道国劳工标准影响中国OFDI的方式存在显著差异,其中,发达国家和新兴工业化国家劳工标准中消除就业歧视对中国OFDI的影响最大,而发展中国家安全的工作环境则是首要影响因素。中国企业在进行海外直接投资时需要慎重考虑劳工标准的影响,综合而言,新兴工业化国家是最佳的投资选择。
While protecting laborers legitimate rights and interests,labor standards will also affect the attractiveness of foreign direct investment in host countries.Based on the data of 43 countries in the“Belt and Road Initiative”from 2006 to 2015,this paper studies the influence of host country s labor standards on China s outward foreign direct investment(OFDI).The study found that labor standards not only directly affect China s OFDI,but also indirectly affect China s OFDI through bilateral investment agreements and the host country s institutional environment.It is manifested that the labor standard clauses included in the bilateral investment agreement are only significant for China s investment in developed countries along the“Belt and Road”.The impact is not significant for newly industrialized countries and developing countries,and the host country that signs bilateral investment agreements with China(or labor standards clauses in bilateral investment agreements)has a stronger protection of domestic labor rights preferences with the improvement of system quality.The newly industrialized countries are the most obvious.Further research shows that there are significant differences in the ways in which host countries labor standards affect China s OFDI at different levels of economic development.Among them,the elimination of employment discrimination in labor standards in developed countries and newly industrialized countries has the greatest impact on China s OFDI,while the safe working environment in developing countries is the primary.Influencing factors.Chinese companies need to carefully consider the impact of labor standards when making overseas direct investments.In general,newly industrialized countries are the best investment choice.
