摘要
基于国内外研究现状,梳理引发PPP项目再谈判的主客观原因,以财政部PPP综合信息平台中57份交通运输行业PPP合同为研究样本,从项目前期、建设期、运营期三个阶段分析我国交通运输行业PPP合同中再谈判触发机制,从重大政府失信行为、项目外收入调整、特许经营期调整三方面提出完善再谈判触发机制的建议。
Based on the research status,this paper teases out the subjective and objective reasons for triggering renegotiation of PPP projects,analyzes 57 PPP contracts of the transportation industry in the national PPP integrated information platform to study the triggering mechanism of renegotiation from the pre-project, construction period and operation period. Finally,puts forward recommendations from three aspects:major government breach of trust,adjustment of outside income,adjustment of franchise period.
