摘要
在中国特色的政府生态责任追究体系中,人大是最具权威性的监督和追责主体,但其监督和追责职能的制度规定与实际履行的差距依然明显。人大追究政府生态责任的职能定位应当坚持中国特色取向、人大权责一致、职能定位过程以及生态相对优先的基本原则,应当既要说明人大中由谁来追究责任和追究政府中谁的责任,也要考察追究政府什么性质的责任和人大如何追究政府责任。制约人大追究政府生态责任职能实现症结点主要在于人大自身建设的不足、生态社会力量的薄弱以及作为追责对象的政府掣肘。因此,针对上述症结点,运用公共管理创新理论,推进人大追究政府生态责任职能实现的主要着力点应当在于不断提升人大追责动力和能力、培育成熟的生态社会力量和构建新型的合作追责模式。
In the government’s ecological accountability system with Chinese characteristics, the National People’s Congress(NPC) is the most authoritative body of supervision and accountability, but its institutional rules for supervision and accountability are apparently different from the actual implementation. The NPC’s role in holding the government accountable for ecological issues should adhere to the basic principles of Chinese characteristics, consistency of powers and responsibilities of the People’s Congress, the process of function orientation, and the relative priority laid on ecological issues. It should explain who is responsible for the accountability function of the NPC, and who is held responsible for the government act. It is also necessary to examine the nature of the government’s accountability and how the NPC can hold the government accountable. Major difficulties that restrict the NPC’s function in holding the government accountable for ecological issues can be found in the following aspects: insufficient institutional building of the NPC, the weakness of the ecological and social forces, and the obstacles from government as the target of accountability. Therefore, in view of the above-mentioned difficulties, it is advisable to applyinnovation theories in public governance. The major focus in promoting the NPC’s function in holding government accountable for ecological issues should be placed on continuously improving the power and ability of the NPC to determine accountability, cultivating mature ecological and social forces, and building a new type of cooperative accountability model.
