摘要
普遍管辖权是近年国际法热点问题,其适用引发滥用争议。为解决问题、达成共识,根据现有国际法规范,结合法理与实践,提出判断权力滥用的两个标准:普遍管辖权的行使是否具有法律依据,是否尊重他国主权豁免。适用普遍管辖权不应以正义价值为唯一、绝对诉求,要注意维护不同价值、利益间的平衡,确立权力滥用标准有助于协调普遍管辖制度与现有的国际法结构,为其巩固与发展建立路径。
Universal jurisdiction has been an International Law’s hot issue in recent years, but its application has caused controversy about power abusing. In order to solve these issues and reach consensus, two standards for judging abuse of power have been proposed based on the existing norms of international law and combined with legal principles and practice. These two standards are whether there exists legal basis of the execution of universal jurisdiction and whether the sovereign immunity of other countries are respected. The application of universal jurisdiction shall not take the value of justice as the sole and absolute appeal, but heed to maintain the balance among different values and interests. The establishment of standards for abuse of power is conducive to the coordination between the universal jurisdiction system and the existing structure of international law, thus building a route for the consolidation and development of universal jurisdiction system.
