摘要
廷杖是皇权高度专制的集中体现,是明代的"恶政"之一。实际上,廷杖并非明代的发明,它具备了制度的基本属性,皇帝不可以恣意滥施。廷杖的施行不仅要遵循基本的规定,大臣还努力将廷杖纳入国家正常的司法体系之中。中国传统末世的制度建设越来越精致,既具有近代性的因素,又深植于旧制度之中,蜕变过程极其漫长。
Ting Zhang is a concentrated reflection of the highly autocratic imperial power and one of the"evil policies"of the Ming dynasty.In fact,Ting Zhang was not an invention of Ming dynasty,and it had the basic attributes of the system,therefore the emperor could not arbitrarily abuse it.The implementation of Ting Zhang should at least follow the basic rules,and the ministers tried to incorporate it into the normal judicial system of the country.The system construction of Chinese traditional eschatology was more and more sophisticated.It had both modern factors and deep roots in the old system.The process of transformation was extremely long.
