摘要
环境影响评价作为重要的环境保护法律制度,往往涉及建设者与反对建设者之间,价值观与利益之间的冲突及取舍,以及利益与风险负担的平衡问题。因此环评公众参与机制具有不可忽视的法制度价值。但目前我国相关立法中,对环评参与主体"公众"界定比较模糊,内容不统一、混同。为了进一步解决环评公众参与的可操作性问题,应采用总分、排除法+类型化的定义方法,对环评参与主体"公众"做更深入、更细致的制度设计,打破公众参与在学理和规范上的缺位现象,保证公众的代表性、全面性和利益相关性,更好发挥公众参与的机能。
As an important legal system of environmental protection,the environmental evaluation often involves the conflict and trade-offs between builders and opponents,values and interests,and the balance between interests and risk burdens.Therefore,the environmental assessment public participation mechanism has the value of the legal system that can not be ignored.However,the definition of“public”in the relevant legislation of China is relatively vague,and the content is not uniform but confusion.In order to further solve the problem of the operability of EIA public participation,we should adopt the defining method of total score,exclusion method and typification,make more in-depth and institutional design for the“public”of EIA public participation,break the vacancy of public participation in theory and norms,and ensure the representativeness,comprehensiveness and interest relevance of the public,and better play the role of public participation.
