摘要
经过40年的改革与社会功能的分化,我国的法学本科教育已经成为了教育系统与法律系统的"系统接口"。为了有效发挥法学院的社会功能,法学本科教育的"人才质量标准"应当设定为"确保学生在掌握基本概念、原则和规则的基础上,拥有法律思维,具备像法律人一样思考和分析问题的能力。"培养学生的"法律思维"是法学本科教育不可推卸的责任,但法律职业技能的培训应当由法官学院、检察官学院、行政学院以及律师学院来完成。法学院的本科教育培养目标和教学方法应当与国家统一法律职业资格考试相衔接,但法学院不应承担职业资格考试培训机构的功能。
With the reform and social function differentiation,the undergraduate legal education has been the“system interface”between the legal system and education system.To carry out the social function of law school,the product standard of talent of the undergraduate legal education should to set up as“To ensure that students have legal thinking and the ability to analyze problems like the lawyer on the basis of analyze legal concepts,principles and rules.”The duty of the undergraduate legal education is training the student’s“legal thinking”,and the duty of the College of judges,College of Prosecutors,College of administration and College of attorney is training the legal profession skill.The talent training programs and teaching methods of undergraduate education in law schools shall be in line with the National Uniform Legal Professional Qualification Examination,while the training the student to pass the Examination isn’t the law school’s function.
