摘要
通过对广东省及几个典型的区域性/综合性劳动关系治理经验的梳理、分析和比较,可以看出,政府主导的区域性劳动关系治理体现了对劳资矛盾的预警、调解和处置的一体化设计,构建了从企业到诉前的多层次调解网络,更注重发挥社会组织在调解中的作用;工会主导的劳动关系治理具有多样性特点,既有组建、服务、维权三位一体的源头治理,也有以服务为主的区域治理,更有"区域+行业"的综合治理。在此过程中,地方工会在组织体制、工作机制和工作方式上进行了不同程度的改革创新,打通了"服务职工最后一公里"。政府的制度安排怎样和工会的源头治理形成联动,是未来区域性劳动关系治理的关键。
This study focuses on analyzing and comparing several typical experiences of regional and comprehensive governance of labor relations in Guangdong province.The paper shows that the government-led regional governance of labor relations reflects the integrated design of the early warning,mediation and disposal of labor-capital contradictions.Furthermore,the design has built a multi-level mediation network from enterprise to the pre-litigation,paying more attention to the role of social organizations in mediation.Thus,the union-dominated labor relations governance strategy has a diversity of features,including not only the trinity source governance of the trade union construction,service,and rights protection,but also the service-based regional governance as well as the comprehensive management of regional industry.In this process,the local trade unions have carried out reforms and innovations on different levels in its’organizational systems,working mechanisms,and work methods,opening up the last mile service for employees.Hence,the key to future regional governance of labor relations is to how to coordinate government institutional arrangements with the source governance of the trade unions.
