摘要
政策试验是独具中国特色的政策制定过程中的一个重要环节,中央和地方的互动关系是其核心。政策试验要想取得成功,中央推进和地方创新缺一不可。中央推进不仅指中央提供的强有力支持,更重要的是不能忽略它的引导和及时纠偏的作用。地方政府是政策试验的具体实施方,它的积极性是政策试验得以展开的起点。《湖南省行政程序规定》的出台是政策试验在法治领域的典型体现。中央推进具体表现为提出完善行政决策程序这一政策目标,湖南省试验立法的成功体现了央地良性互动的重要性,其开门决策的做法实现了法治湖南的跃升。
Policy experiment is an important link in the process of policy making with Chinese characteristics,and the interaction between central and local governments is its core.In order to succeed in the policy experiment,the central propulsion and local innovation are indispensable.The central propulsion not only refers to the strong support provided by the central government,but also refers to its guidance and timely correction of policy experiments.The local governments are the concrete implementers of the policy experiment.Therefore,their enthusiasm is the starting point of the policy experiment.Introduction of Regulations on Administrative Procedure in Hunan Province is a typical manifestation of policy experiment in the field of the rule of law.The central propulsion is embodied in proposing policy objectives of improving the administrative decision-making procedures.The success of experimental legislation in Hunan Province reflects the importance of positive interaction between central and local governments.At the same time,the practice of opening decision also achieves the rule of law in Hunan.
