摘要
《环境权理论的新展开》一书隐含着环境权研究进路的三种转向:从程序权利到实体权利,从衍生权利到独立权利,以及从集体权利到个体权利。此外,我们可以进一步思考环境权研究进路的第四种转向,即从社会权利到连带权利。在当下学界过于强调环境权的程序面向、衍生面向、集体面向和社会面向的背景下,突出环境权的实体面向、独立面向、个体面向和连带面向在环境权研究进路的转向层面具有重要的理论反思意义。当然,环境权的宪法确认主要依靠政治决断,而非理论反思。
There are three changes of research approaches to environmental rights implicit in the book New Development of Environmental Rights Theory,i.e.,from procedural rights to substantive rights,from derivative rights to independent rights,and from collective rights to individual rights.Moreover,we can further think about the fourth change of research approach,that is,from social rights to solidarity rights.In the context that the current academic circles place too much emphasis on procedural,derivative,collective and social aspects of environmental rights,it is of great theoretical reflection significance to highlight substantive,independent,individual and solidarity aspects of environmental rights in the level of the changes of research approaches.Of course,the constitutional confirmation of environmental rights mainly depends on political decision rather than on theoretical reflection.
