摘要
随着整体主义环境观的提出,根据"新生态学范式"的要求,以功利主义为代表的传统法学方法论因囿于"理性人"与环境污染认知且受限于"浅技术化"手段,无法连接环境法理与自然科学理论的弊端更加明显,以致环境法缺乏"生态化"特质的问题未能得到根本解决。而随着以解释主义为代表的交叉性学科方法论的发展,特别是复杂理论的成熟,为解读人与环境的"生态化"、"社会化"特质,解释环境系统与人类社会之间的关系,消除环境法中的复杂因素,丰富环境法理供给以及链接自然规律与法律规则提供了基础和方法。以此为出发点,借助解释主义方法论,通过赋予环境"自由发展"的空间和强化自然人的环境责任来完善环境法,才能使环境法真正顺应自然规律。
With the advancement of the holistic environmental concept,according to the requirements of the"new ecologicalparadigm",traditional legal methodologies represented by utilitarianism are limited by"rational economic man"theory and en-vironmental pollution cognition as well as "shallow technical" means. Their drawbacks of being unable to connect environmen-tal laws and natural science theories have become more and more serious,therefore the problem that environmental laws lack"ecological"characteristics can not be fundamentally resolved. The interdisciplinary methodologies represented by interpreta-tionism,especially the complex theories,provide basis and methods for interpreting the"ecological"and"social"characteris-tics of people and the environment,for understanding the relationship between environmental systems and human society,foreliminating the complex factors in environmental laws,for enriching the supply of environmental jurisprudence,and for linkingnatural laws and legal rules. Taking this as the starting point,by virtue of interpretationism methodologies,environmental lawscan be completed by leaving space for environmental"free development"and strengthening the responsibility of natural per-sons,so that the environmental laws can truly conform to the law of the nature.
