摘要
法定义务并非义务的唯一形态,在法定义务之外尚有民间规范义务形态。民间规范义务是民间规范的重要组成部分,其可对民间规范权利起到必要的制约作用,并就社会秩序的维系而言具有重要意义。在法治语境下,民间规范义务有向法定义务进行转化之必要,民间规范义务的司法识别标准包括"应然"性质的规则主张和主体间的重复性行为,同时其既不能与法律规范义务相冲突,亦不能有悖于公序良俗。
The legal obligation is not only form of obligation, in addition to the legal obligation there is the obligation of folk norm. The obligation of folk norm is an important part of folk norm, it plays an important role in restricting the right of folk norm and maintaining social order. In the rule of law, it is necessary for the obligation of folk norm transform to the legal obligation. Judicial identification for the obligation of folk Norm include the rule-based nature of ＂should＂, and the repetitive behavior form the peo- ple. Besides, it can neither conflict with the law nor violate public order and good customs.
