摘要
立法认可与司法确认是民间规范结构正式秩序的两种主要方式,而权利正是民间规范得以且必须建构正式秩序的关键要素.与法律规则权利的法定属性相类似,民间规范之权利正是习惯权利的规范表达.习惯权利的司法识别标准包括“应然”性质的规则主张和主体间的重复性行为,同时其既不能与法定权利相冲突,也不能有悖于公序良俗.
The practice of folk norm to become a legal norm includes legislation and justice,rights is the key that folk norm must be structured to the formal order. Similar to the legal properties of legal rights, the right of folk norm is the norm expression of the traditional rights. The recognition criteria of the traditional rights include the rules of the "should" character and the repetitive behaviors between the people,and it cannot conflict with legal rights,nor does it violate the public order and good customs.
