摘要
公益法作为"弱者的武器",可以为性别公正事业提供一个较好的视角。近年来,我国的单身女性生育权系列法律实践,已经具备公益法活动的元素和公益法操作的可能性。通过公益法实践的一般操作程序,即从主题的选择、案件的规划、策略的运作和后期拓展方面来分析我国单身女性生育权法律实践的得失,并就其可能的操作路径提出某些设想。在此基础上认为,应当在广泛的人权视野下开展女性权利事业;要意识到不同类型女性维权实践的特殊性;公益法实践需要对案件各方面构成要素做到准确把握,努力寻找制度变革和社会变迁的契机点;应该从长远的角度开展性别公正的公益法实践。
As a weapon for the weak, the Public Interest Law can provide a better perspective for the cause of gender justice. In recent years, the legal practice of single females＇ reproductive rights in China has already possessed the elements of public interest law activities and the possibility of public interest law operation. Through the general operating procedures of public interest law practice, that is, from the choice of subject, the planning of the case, the operation of the strategy and the later development, the paper analyzes the gains and losses of the legal practice of single females＇ reproductive rights in China, and puts forward some ideas on its possible operation methods. On this basis, it is believed that the cause of women rights should be carried out under the broad human rights perspective; it is necessary to realize the particularity of different types of women rights protection practice; the practice of public interest law needs to accurately grasp the constituent elements of all aspects of the case, and strive to find the opportunities of institutional and social change; the practice of public welfare law of gender justice should be carried out from a long-term perspective.
