摘要
基本权利保护是宪法运行的实质内核。对德国和中东欧国家宪政发展与公民权利保护的互动关系考察后可以得出启示:公民对于国家的制度性需求会推动国家宪法的发展,国家权力的可制约性及国家权力运行的有效性都是围绕公民权利保护这一目标,公民权利的保障程度和宪法发达程度呈正向促进关系。从十八大的法治思维到十九大的违宪审查,以宪法理念统领宪法实践以保护公民权利,是借鉴他国宪政经验,根植于本土实际,推进依宪治国战略的伟大工程。
Legal protection of civil basic rights represents the the core and essence of constitution operation.The investigation on interactive relations between constitutional development and civil rights protection in central and eastern European countries and Germany gives us enlightenment that citizens＇ needs for the state institutions promotes the national constitutional development,that the conditionality of the state power and the state power operation are both aimed at civil rights protection, and that the degree of protection of civil rights and constitutional development shows positive promotion relations. The rule-of-law thinking of the 18 th National Congress of the CPC and constitutional review of the 19 th National Congress of the CPC focus on civil rights protection on the basis of constitutional concept-led constitutional practice,which uses the foreign constitutional experiences for reference, takes roots in domestic practical conditions and promotes the great project of constitution-based state governance strategy.
