摘要
法律原则对于统一公法学的建构具有十分重要的意义。统一公法的基本原则应当体现各部门公法之共性。各部门公法面临的共同问题是法的形式理性与实质理性的冲突。有利相对方原则体现了各部门公法的共同规律,具有弥补规则不能适用的功能。
Principle of law has very important significance for the construction of the unified public law. On the fundamental principle of the unified public law should reflect the common laws of all the sectional public laws legal. The sectional public laws facing a common problem is the conflicts between the formal rationality and substantive rationality of law. Principle of being advantageous to counterparts reflects the common laws of all the sectional public laws, and it can amend situations where regulations are inapplicable.
