摘要
尽管我国教育法律法规业已明确高校法人资格,但是对高校法人财产权规定模糊不清,加上我国公办高校处于"一元所有权""政资不分""所有权虚置"的尴尬处境,导致我国公办高校产权的激励和约束机制失效,高校行政化问题进一步加剧,高校法人自主办学渐趋流于形式。为此,应从体制机制改革入手,采取多种形式推进公办高校产权结构多元化;加快政府职能转变,实现政资分开和管办分离;确立高校法人所有权,构建法人共同治理机制,最终破除公办高校法人财产权的制度性困境,落实高校法人主体地位,实现高校法人依法独立自主办学。
Although educational laws and regulations in our country have already recognized the university corporation qualification,the provision of corporate property rights is blurred,and the public universities is in the embarrassing situation of ＂absolute ownership＂ and ＂not separation of administrative power and property rights＂, ＂ownership fause＂,which leads to failure of the incentive and restraint mechanism of China＇s public university property rights. The problem of universities bureaucratization is further exacerbated,and the corporate autonomy is a mere formality. Therefore,we should proceed with the reform of system and mechanism,adopt various forms to promote the diversification of public university property structure;accelerate the transformation of government functions to achieve ＂the separation of administrative power and property rights＂ and ＂the separation of administrative and management＂;establish the corporate ownership of universities and construct the common governance mechanisms,break institutional predicament of public universities property rights,implement the corporate status of universities and manage school independently according to law.
