摘要
"成案"对清代刑事裁判的正当化论证具有重要意义,但其本身却并非正式的法律渊源。成案主要功能,在于"援案定法"与"援案定罪",即以既有"成案"来佐证当前律例选择或量刑的准确与恰当。成案是否具有法律效力、能否成为判案依据,取决于其是否符合律例的规定或皇帝的意志。成案在司法论证中主要的运用方式,是律例规范引导下的具体情节类比。
The leading case is of great significance to the justification of criminal judgment in Qing Dynasty,but it is not the formal legal source. The main function of the leading case is that＂selecting the correct law according to the case and deciding the appropriate punishment according to the case＂,in other words,it is to prove correctness and appropriateness of selecting law or sentencing on the basis of the existing ＂ leading case＂. Whether the case has the legal effect,whether it can be the legal basis of adjudication,depending on whether it is consistent with the provisions of the statute or the emperor＇s will. The main application of the leading case in the judicial argument is the concrete analogy of the plot guided by the rules and regulations.
