摘要
法治这个概念所固有的复杂性和内在冲突性,在很大程度上导致了实质法治和形式法治这两个术语在理念和功能上的矛盾性。重构实质法治和形式法治的功能性定位,采实质法治场域和形式法治场域二元发展路径,是中国新一轮法治建设欲取得显著成效的方法论上的对策。法治二元场域并举的法治实施构想,有利于法律实施场域的形式法治建设与立法场域的实质法治建设交相为用,互为支撑,逐步实现国家治理能力和治理体系的现代化。
The inherent complexity and inner conflicts of the concept of rule of law,to a large extent,lead to the contradiction of the concept and function of the two terms,namely substantive rule of law and formal rule of law. Reconstructing the functional orientation of the substantive rule of law and the formal rule of law,and adopting the dualist development path featured by the field of substantive rule of law and that of formal rule of law,are the methodological countermeasures for the new round of rule of law construction to obtain remarkable results in China. The conception of the implementation of the rule of law from the perspective of Dialectical Binary Field,in the form of the field of law implementation centered on formal rule of law and the field of legislation focusing on the substantial construction of the rule of law,with two fields mutually supported,is beneficial to the upgrading of the rule of law and the realization of the modernization of the national governance capacity and the governance system.
