摘要
本研究借助参与观察法,对合适成年人参与制度的微观实践过程进行了细致考察,发现座位设置、身份告知方式等看似不起眼的实践方式会明显制约对儿童权利的保护。在这些微观实践的背后,隐含着更深层的限制:对合适成年人角色理解的偏差,对未成年嫌疑人权利理解的偏差,以及合适成年人的弱势地位无法对办案人员的权力形成有效约束等。为了让合适成年人在保护涉案未成年人的权利中扮演更积极的角色,未来研究需要探索如何消除上述限制。
This article examines meticulously the micro-practices of appropriate adults who attend juveniles held in police custody in China. It is found that some seemingly trivial arrangements, such as the seat positions of appropriate adults and the ways in which the identity and the role of appropriate adults were informed, have limited the protection of the rights of the child. Beneath the visible limitations, there were deeper restrictions, including the misunderstood role of appropriate adults, the confusion of suspects with criminal, and the powerlessness of appropriate adults in the face of the police. Future studies need to explore the ways to eliminate the restrictions so that appropriate adults can play a more active role in the protection of the rights of the child suspect.
