摘要
合适成年人讯问时在场的形式化倾向趋于严重,这一制度背后的少年司法价值取向与我国囿于刑事司法的未成年人诉讼程序之间的张力已逐渐凸显。在合适成年人制度的实际运作中,办案人员、合适成年人与未成年人应当基于帮教的价值目标共同参与讯问,多方主体立足于参与讯问所展开的互动合作是保障制度效果的应然关系状态。家庭模式理论可以为此提供正当性解释,经验考察也在一定程度上验证了上述判断。办案人员的主导讯问与排斥参与、合适成年人的主动配合与消极旁观、未成年人的被动表达与有限参与,使多方主体共同参与讯问的联动效应难以形成。改革的整体思路应当从权力主导转向权利保障,通过规范办案人员的具体职责,明确合适成年人的独立地位与权利义务,使其共同引导未成年人参与讯问。就此探索我国未成年人刑事诉讼中的家庭模式,亦有重要的理论价值与实践意义。
The formalization of appropriate adult’s presence during interrogation tends to be deteriorated.The tension between the juvenile justice value orientation behind this system and the juvenile procedures confined to criminal justice in our country has gradually become prominent.Interrogation staff,appropriate adults and juveniles should participate in the interrogation process based on common value objectives in the actual operation of the appropriate adult system.Multiparty entities based on the interaction and cooperation in the interrogation process is the relationship status that guarantees the effectiveness of the system.The family model theory provides a legitimate explanation.The empirical investigation has tested and confirmed the above judgment to a certain extent.The leading interrogation and rejection of participation by Interrogation staff,the active cooperation and passive observation of appropriate adults,and the passive expression and limited participation of juveniles make it difficult to form the linkage effect of multiple parties participating in interrogation.The overall thinking of the reform should shift from power-oriented to rights protection,by regulating the specific responsibilities of interrogation staff,clarifying the independent status and rights and obligations of appropriate adults,so that they can jointly guide juveniles to participate in interrogation,so as to achieve interactive cooperation between multiple parties.Taking this as an entry point,exploring the family model in China’s juvenile criminal proceedings also has important theoretical and practical significance.
