摘要
随着网络游戏成为许多年轻人生活中的一部分,网络虚拟财产也渐渐成为法学界关注的焦点,尤其是在确定网络虚拟财产法律属性的问题上仍然存在很大的争议。而在实践过程中,不同法院在处理网络虚拟财产纠纷时,同样存在分歧,进而导致相似的案件却存在完全不同的判决结果,这种情况的出现不利于网络虚拟财产的保护。拟从两个方向解决以上问题:一是明确网络虚拟财产的特性,通过各种学说分析总结网络虚拟财产的法律属性,并以网络虚拟财产产生的基础法律关系——用户与网络服务商之间的服务合同为视角,解释依附于服务合同下的网络虚拟财产特性以及其与服务合同之间存在的特殊关系;二是解决缺少配套法律保护机制下的网络虚拟财产的保护问题,以及实践中影响用户实际利益的网络虚拟财产价值评估问题。
As network game has become a part of the life of many young people,the virtual property of the network has gradually become the focus of the law circles,especially in the problem of determining the legal property of the virtual property of the network.In the process of practice,different courts have disagreement on the dispute of virtual property of the network,which leads to the existence of completely different judgment results in similar cases.It is not conducive to the protection of the virtual property of the network.Therefore,this article intends to solve the above problems in two directions.One is to clarify the characteristics of the virtual property of the network,to summarize the legal properties of the virtual property of the network through various theories,to interpret the service contract between the users and the network service providers as the perspective of the basic legal relations produced by the network virtual property,and to explain the characteristics of network virtual property under the contract and its special relationship with the service contract.The other is to solve the problem of network virtual property protection under the lack of supporting legal protection mechanism,and the value assessment of network virtual property which affects the actual interests of the users in practice.
