摘要
村规民约作为乡村内生的治理文本,在传统社会因皇权止于县政与乡村的相对自治、乡土中国与"熟人社会"、村庄共同体与价值认同、乡绅治理与权威性裁决机构等社会基础的存在,发挥了重要的秩序整合与规训作用。随着改革开放的推进,传统村规民约赖以发挥作用的社会基础发生了诸多变化,尤其是政权下乡与下村、"后乡土中国"与"半熟人社会"、村庄共同体的消解与个体化的突显、旧裁决机构的退场与新裁决机构权威性的消解等,导致传统村规民约的治理作用逐渐削弱。基于此,进一步从村规民约自身的治理优势、党和国家的政策支持、村规民约与现代乡村治理体系的契合等3个方面分析了村规民约重构的可行性,并针对性地提出重塑"乡政"与"村治"的关系、重建公共性与共同体、构建权威性裁决机构、构建村规民约与现代乡村治理体系的融合机制等重构路径,以推动村规民约在乡村治理现代化进程中继续发挥积极作用。
In the history of rural governance in China,the village social convention played an important role in the integration of social order and disciplinary proceeding because of its social foundations,including imperial power stopped at the county government and the relative autonomy of the village,native China and the ＂ acquaintance＂ society,village community and value recognition,squire management and authoritative adjudication agency. Nevertheless,after the reform and opening,the village social convention functions are declined gradually,because its social foundations has undergone many changes,especially in these areas,regime penetrating into rural society,rear native China and limited acquaintance society,digestion of rural community and individualization,the dispel of the old adjudication agency and the lack of authority in the new adjudication agency. Based on three aspects of analysis,the governance advantages of the village social convention,the support of party and national policy,the suitability between the village social convention and modern rural governance system,this article tries to provide some suggestions to reconstruct the village social convention in order to enhance the efficiency of the rural governance. These suggestions are proposed from four aspects. First,we need to adjust the relations between township government and village committee. Second,we need to reconstruct publicity and rural community. Third,we must make village committee become an authoritative judging agency. Fourth,we should also establish a fusion mechanism between the village social convention and modern rural governance system.
