摘要
1978年以来我国民办高等教育国家政策法规主要在角色和层次定位、办学规定和教育属性界定等方面发生了演变。这些演变以"历史否决点"为依据具有不同的阶段性特征。影响政策法规演变的主要因素有主要行动者、政策法规环境、已有政策法规和社会需要。政策法规演变以诱致性变迁为主,体现出"结果性逻辑"与"恰当性逻辑"之间以及路径依赖和路径突破之间的博弈与调适。政策法规演变中出现了立法不科学和政策法规错位、矛盾,政策法规歧义和表述模糊,以及政策法规内容不周延和执行力弱等问题。因此,要基于效应预期强化积极效应和避免消极效应,格外注重改革和发展中的公平性问题,妥善处理政策法规演变中的现实问题,营造政策法规演变的良好环境和氛围,以重构民办高等教育政策法规演变的路径。
Since 1978, national policies and regulations on private higher education have evolved mainly in the aspects of role and level orientations, school-running regulations, educational attribute definitions and so on.These changes are based on the "historical veto point" and have different characteristics at different stages. The main factors that affect the evolution of policies and regulations include main actors, the policy and regulation environment, existing policies and social needs. The evolution of policies and regulations is mainly the induced change, which reflects the game and adjustment between "the logic of consequentiality" and "the logic of appropriateness", as well as path dependence and path breakthrough. In the evolutional process of policies and regulations, there have been problems such as the unscientific legislation and misplaced and contradictory policies and regulations, the ambiguous and vague expression of policies and regulations, and the incomplete content and weak enforcement of policies and regulations. The evolution of policies and regulations on private higher education should expand the positive effect while overcome the negative effect on the basis of effect expectation. Special attention should be paid to the fairness of reform and development. The practical problems should be handled properly in the evolution of policies and regulations. The good environment and atmosphere should be created for the evolution of policies and regulations.
