摘要
农村环境治理法律进路的逻辑起点是农村环境保护的负外部性因素,强调"政府主导、协作共治"的环境公私协作则为破解农村环境治理困境、实现农村绿色发展提供了新方法和新思路。鉴于农村区域独特的生产生活习俗和环境问题应当重整政府管制、市场调节与基层自治在农村环境治理中的治理作用,以政府的政策引导、公私部门的合意约束及基层组织与村民的参与和监督为具体的法律进路。
The logic starting point of the legal approaches for rural environmental improvement is the negative externalities in the rural environmental protection,and the Environmental Public-Private Partnership（EPPP）in which the government and the private collaborate the governance provides a new perspective to alleviate the difficulties faced by rural environmental governance,and a green develop rural area.Owing to the unique customs and special causes of environmental problems in rural areas,we should attach great importance to government administration,market regulation and local governance.A legitimate approach would be to integrate government policies,coordination between the public and the private,participation and super vision of the local organizations andvillager into rural environmental governance.
