摘要
程序行政行为一律不可单独起诉是司法实践中形成的不当惯例。69号指导案例打破这一惯例并确立了程序行政行为的可诉标准:"明显的权利义务实际影响+无法起诉相关实体行政行为"。该指导案例的裁判要点对可诉标准的提炼并不准确,未能恰当描述出程序行政行为可诉的复杂类型。程序行政行为的可诉标准应表达为:第一,被诉行为确属程序行政行为是程序行政行为可诉的前提条件;第二,在满足以下三个标准之一时,程序行政行为即应可诉:程序行政行为具有终局性;程序行政行为违反法定程序可能导致实体决定被撤销;程序行政行为已对当事人的合法权益造成事实上的不利影响。
The inability to prosecute procedural administrative actions alone is an improper convention in judicial practice. The Guiding Case No. 69 broke this convention and established a standard for actionability of procedural administrative actions: "the actual effect of obvious rights and obligations+ the inability to sue the relevant entity's administrative actions. " The judgmental key point of the guiding case on the extractability standard is not accurate and fails to properly describe the complex type of actionable administrative actions. The standard of actionability of procedural administrative actions should be ex- pressed as follows: First, the procedural administrative actions are the precondition for the procedural ad- ministrative actions to be sued. Second, when one of the following three criteria is met, the procedural administrative actions shall be acceptable: The procedural administrative actions have finality; the procedural administrative actions may violate the statutory procedure and may cause the entity' s decision to be revoked; the procedural administrative actions have caused de facto adverse effect on the legitimate rights and interests of the parties
