摘要
《最高人民法院关于适用〈中华人民共和国行政诉讼法〉的解释》中将过程性行政行为排除在行政诉讼范围之外,其主要理论依据是行政成熟原则等理论的适用,但是通过对相关的规范以及司法判例的分析,过程性行政行为并非一律不可诉,而是以不可诉为原则,以可诉为例外。那么就需要确立过程性行政行为的范围,在此基础上参考国内外的立法例与判例,进一步确定可诉的过程性行政行为的判断标准,即在满足《行政诉讼法》所规定的行政行为构成要件的前提下,将已转化为最终行政行为的过程性行政行为和满足产生外部效力且与相对人有利害关系且具有司法审查必要性的复合标准的过程性行政行为纳入司法审查的范畴。
The Supreme People’s Court’s Interpretation of the Application of the Administrative Procedure Law of the People’s Republic of China excludes procedural administrative acts from the scope of administrative litigation.Its main theoretical basis is the application of theories such as the principle of administrative maturity.However,through the analysis of relevant norms and judicial precedents,procedural administrative acts are not always non-prosecutable,but are based on the principle of non-prosecution with justiciability as the exception.Then it is necessary to clarify the scope of procedural administrative acts.On this basis,by referring to the domestic and foreign legislation and jurisprudence,the criteria for judging procedural administrative acts that can be prosecuted are confirmed.That is,on the premise of meeting the constitutive requirements of administrative acts stipulated in the Administrative Procedure Law,those procedure administrative acts should be included in the scope of judicial review,like the procedural administrative acts have been transformed into final administrative acts,and those satisfying the requirements that have external effects and phase and are of interest to people.
