摘要
中国法律传统的创造性转化不能通过对儒学进行纯化或限缩讨论的范围来实现,传统本身就可具有方法论的意涵。这可称之为"作为方法的传统",从而改变传统自身只是作为一个被改造或被复制的对象的地位。高次元的传统和西方法学观念都是我们关于当下法律实践之自我理解的重要成分,前者需要新的制度表达,这需要在方法上会通中西,对我们所共享之理想生活的形式做出价值判断。容隐制并未随着礼法合流的解体而消退,而是吸收了近代法律的自由和平等观念,获得了新的制度表达并重新焕发出生命力。根本原因在于,"亲亲"是对人类情感的正面肯定,它是具有普遍适用性的价值。容隐制的近代化既非简单的移植,也非单纯地"证之于古"。
The creative transformation of Chinese legal tradition cannot be achieved through the purification or limited discussion of Confucianism and the tradition itself can have methodological implications.This can be called"the Tradition as Method",thereby we can change the status of the tradition itself as an object that has been transformed or copied.High dimensional tradition and western legal conceptions are important components of the self understanding on our current legal practices,and the former needs new institutional expression.This will require the communication between Chinese and western legal thoughts in the method,and we need to make value judgments on the form of the ideal life we are sharing."Kin Concealment System"did not fade with the disintegration of the confluence of"Li"and laws,but absorbed the concept of freedom and equality of modern law,gained new institutional expression and renewed vitality.The basic reason is that"kins"is a positive affirmation of human emotion,and it is a value with universal applicability.The modernization of"Kin Concealment System"is neither a simple transplantation nor merely a"justification from the ancient",but a creative transformation of itself as the high dimensional legal tradition.
