摘要
我国《宪法》第41条的规范结构及合宪性审查制度的运行实践表明,公民合宪性审查建议权具有监督权和救济权的双重属性。近年来,公民合宪性审查建议权逐渐成为重要的权利救济手段,与司法制度的冲突开始浮现。亟待整合权利救济渠道,建立公民审查建议的法院移送机制,以维护法制统一与司法公信力。民主监督属性则是《宪法》赋予公民合宪性审查建议权的规范属性,不能因法院移送机制改革而削弱。为此应当放宽对建议人的主体资格限制,赋予普通公民为公益起诉并提出审查建议的权利;并在合宪性审查制度中设立听证程序,作为加强民主监督属性的措施。
Both the normative structure of Article 41 of the Constitution and practices of constitutional review- prove that the citizen＇ s right to make suggestions for constitutional review has the dual nature of supervision and re- lief. In recent years, the right to make suggestions for constitutional review is turning into an important means of re- lief gradually, which causes its conflicts with the judiciary. To uphold the uniformity of the legal system and the judi- cial credibility, it is imperative to integrate rights relief channels and to establish the judicialtransferprocedureof citi- zen＇s suggestions for constitutional review. According to the Constitution, democratic supervision is the normative nature of the citizen＇ s right to make suggestions for constitutional review. It should not be weakened by the reform of the judicial transfer procedure. For this purpose, thesubjectqualificationtomakesuggestions should be less strict, and general citizens should have the right to sue for public interest and to make suggestions for constitutional review in suits. The hearing process should be established in constitutional review as a measure to strengthen democratic super- vision.
