摘要
医疗纠纷的特殊性、复杂性、专业性使得政府在调解机制初期运作中起着主导作用,随着政府购买公共服务理念的推广,福建省已经形成了各具特色的政府购买医患纠纷调解服务模式,但依然存在医患纠纷调解机构法律定位的缺失,医患纠纷调解监管与评估指标不完善,政府给付不足和调解机构中立性不足等法律问题。文章通过分析提出立法应明确政府购买医患纠纷调解服务的法律定位,构建医患纠纷调解服务的监管与评价制度,完善经费支持的多模式探索以及推广独立性购买方式等法律建议。
The particularity, complexity and professionalism of medical disputes make the government playa leading role in the initial operation of the mediation mechanism. With the promotion of the concept of publicservices purchased by the government, the government gradually establishes the mode of purchasing medicaldisputes mediation services in Fujian. This paper analyzes the mode and legal problems of Fujian provincialgovernment＇s purchase of doctor-patient dispute mediation services, and puts forward some legal suggestionssuch as speeding up the relevant legislative construction, improving the intensity of financial support, promotingthe independent purchase mode and constructing the supervision and evaluation system of doctor-patient disputemediation services.
