摘要
保障运动员基本权利是当前全面深化体育改革进程中不可忽视的问题。我国运动员基本权利专门保障内容主要集中在健康权、受教育权、劳动权与社会保障权等方面,这反映了我国当前运动员权利保障的现实需求。运动员基本权利的实现要求国家履行相应的法律义务。为充分保障运动员基本权利,提出在《中华人民共和国体育法》中增设运动员基本权利保障条款,制订《运动员权益保护条例》,加强相关体育行政执法,不断增强运动员权利意识和法治观念等建议。
To protect the basic rights of athletes is an issue that can not be neglected in the process of deepening the reform of sports in an all-round way.The specific protection contents of the basic rights of athletes in China mainly focus on the right to health,education,labor and social security,which reflects the current needs of the protection of athletes＇ rights in China.The realization of the basic rights of athletes requires the state to fulfill the corresponding legal obligations.In order to fully protect the basic rights of the athletes,it is proposed in this article that the provisions on the protection of the basic rights of athletes should be added into the Sports Law of the People＇s Republic of China,the Regulations on the Protection of the Rights and Interests of Athletes should be written into law,the related sport administrative law enforcement should be strengthened,and the athlete＇s awareness of rights and the rule of law should be constantly enhanced.
