摘要
预测功能作为大数据的核心价值,在司法领域逐步彰显出其深远影响。目前,国内法学研究对大数据预测功能关注逐步加强,对于预测功能在我国司法实践中的具体应用及其重要意义的探讨还有待深入,对其可能带来的挑战重视不够。针对我国"智慧法院"的建设现状与存在的问题,应着重从加强预测功能的实际应用,确保基础数据全面性与合理性,确保算法的合理性,提高预测透明度,正确处理案件特殊性等方面探索解决路径。
The function of prediction gradually shows its farreaching influences in the judicial field as the core value of big data. At present, the concern of big data prediction gradually comes into legal research in China. The application of predictive function in judicial practice in China and its significance are not fully analyzed. And no much emphasis was put on the potential challenges of predictive functionality. Facing the problems of the AI Court in China, more practical application shall be made of prediction, more comprehensive and rational of resource data shall be pursuit, the rationality and transparency of the algorithm shall be increased, and the particularity of individual case shall be properly dealt with.
