摘要
姓名权的商业化趋势近年来越来越明显,商人通过对名人姓名搭便车的方式以获得经济效益的现象更是屡见不鲜,随之而来的便是姓名权与商标权的一系列冲突。目前,学界对于这一问题的研究较为零散。本文基于文献综述的视角,通过整理分析相关文献,归纳出名人姓名权与商标权冲突的原因、认定要件、国内相关立法以及解决方案,以期对后续研究有所铺垫。
In recent years, the commercialization trend of name right has become more and more obvious. The phenomenon that businessman gets the economic benefit through "free ride" action of celebrity name is not uncommon. Following those phenomenon are a series of conflicts between name right and trademark right. At present, research on this problem in the academia is fragmented.Based on the literature review, this paper summed up the causes, identification criteria,relevant domestic legislation and solutions of the conflicts between celebrity name right and trademark right, and expect to provide clues for the following research.
