摘要
法律规避是国际私法中一个重要的理论问题,本文在分析了法律规避的一般理论后,结合我国的立法和司法实践,从经济分析的角度阐述了法律规避现象产生原因,从而揭示它之所以存在基础,进一步引申出如何在立法和司法实践中正确地对待这一问题。
Evasion of law is very important issue in private International law. After analyzing the theory of evasion of law,this thesis expounded the reason and the bases of evalon of law from a economic analysis angle.At last, the thesis explained that how to handle the problems about evasion of law in the practice of the legislation and the justice in China.
