摘要
开放政府数据范围问题是开放政府数据发展中首当其冲的难题之一。本文通过对美国联邦政府及州政府开放政府数据范围分析发现,美国开放政府数据核心的价值观就是实现并创造公共价值,并以此为基础对开放政府数据范围做了规定,明确了"数据"概念的要素组成,清晰地对例外情形进行了列举设定。开放政府数据门户网站以政策为指导,提供了丰富的开放政府数据。中国可以借鉴美国开放政府数据范围的政策规定及网站实践的经验,界定"数据"及相关概念,明确我国开放政府数据范围的应然状态和例外数据。
The scope of Open Government Data is the core issue in developing Open Government Data. By analyzing American scope, the author found the Open Government Data core value of the Unite States was to realize and create public values. On the basis of this, the policies defined Open Government Data scope and the elements of the concept of ＂data＂ as well as the exceptions. The Open government data portals were set up in accordance with the relevant policies and offer abundant data. China can learn from the policies and regulations concerning American Open Government Data Scope and its experiences in setting up portals. In the meantime, defining ＂Data＂ and its relevant concepts, China can determine the due state of its Open Government Data and the exceptional data.
