摘要
全国人大及其常委会对监察委员会应有立法权,各级人大及其常委会对同级监察委员会成员应有任免权,对其工作应有监督权。中央监察委员会主任应由全国人大选举(而非决定)产生,即提名人属于人大主席团(而非国家主席)。在宪法规定的人民法院、人民检察院和公安机关办理刑事案件的原则条文中,应增加监察机关。由于我国监察机关的性质接近行政权,因此,监察权应纳入行政诉讼范畴;许多国家对涉及人身和财产的调查权需经法院审查和批准,这值得我们借鉴。检察机关的监督对象应由过去的监督公安、法院、监狱等延伸至监察机关,为此,检察院应保留批准逮捕权,对监察委员会违法行为的纠正权,对其移送案件的审查权等。
The National People＇s Congress and its Standing Committee should have legislate power concerning the supervision commissions,while the people＇s congresses at all levels and their standing committees should have the power to appoint and remove the members of the supervision commissions at the same level,and the power to supervise the supervision commissions＇ operation. The candidate for the directorship of the Central Supervision should be nominated by the Presidium of the NPC＇s Meeting other than by the President and then be elected but not voted by the NPC. The supervisions commission should be added to the constitutional provisions regulating the handling of criminal cases by the courts,the procuratorates and the public security organs. Since the powers of the supervision commission are largely characterized as the executive powers,the disputes concerning the enforcement of such powers should be subjected to the administrative litigation. In many countries,the investigation or search concerning the human body or property requires the review and approval of the Court. This is a valued experience for us. The supervision power of procuratorates has to be expanded to the supervision commissions in addition to the traditional organs such as public security,courts and prisons. As a conclusion,the procuratorates have to maintain its powers to approving the arrest,correcting the wrongful act of the supervision commissions,reviewing the transferred cases and etc.
