摘要
公民的受教育权是一项基本人权,在一定意义上说,受教育权的保障程度关系到公民其他权利的实现程度。残疾人是一个庞大的弱势群体,而保障残疾人的受教育权更是国家不容推卸的宪法责任,国际人权法与我国国内法为残疾人受教育权的切实保障建立了基本的制度架构。为了克服我国残疾人受教育权保障立法上存在的问题,近年来我国残疾人受教育权保障立法出现了新的风格转向。
The right of citizens to receive education is a basic human right.In a sense,the degree of protection of the right to receive education is closely correlated with the realization of other rights.The disabled is a huge disadvantaged group,and the protection of their right to receive education is a statutory responsibility that the state cannot shirk.International Human Rights Law and China's domestic laws have constructed the basic institutional framework for the effective protection of the right to receive education for the disabled people.Through an analysis of the system structure of the framework,the paper puts forward corresponding legislative changes and suggestions for other reforms.
