摘要
全国人大及其常委会制定的"有关法律问题的决定",在立法不能时满足实践对规范的需求,在立法滞后时补充和完善法律,在职权行使时提供便捷方式,由此成为我国法律体系的重要组成部分。就其性质而言,此类决定并非严格意义上的法律,但与法律有着相当密切的关联;虽在形式上表现出"决定"的某些外部特性,但在实质内容上亦有别于其他性质的决定。就其效力而论,此类决定的效力应低于宪法和法律,且不得规定法律保留事项,亦不可过度地变更法律的实施。此类决定得以在繁多法律的"夹缝"中产生,乃是缘于其特有的功能和效用,但由于制度化的缺失与不足,其宪法地位却颇为尴尬。故而需借由有效的制度化方式,促使其功能得以正当持续地发挥。
The decisions on legal issues enacted by the Standing Committee of NPC could meet the demands for rules of society in the cases of legislation impossibly,perfect the legal when the laws is lagging,and provide many ways to use the powers.Therefore,the decisions on legal issues became an integral component of the socialist system of laws with Chinese characteristics.On the character side,these decisions are not but close to the laws,and are distinct from other decisions,although they have some features in common with other decisions.On the legal effect side,the legal force of these decisions is lower than that of constitution and law,but higher than the administrative regulations and local regulations.Meanwhile,these decisions must follow the request of the doctrine of legal reservation and cannot change the application of law excessively.However,the constitutional position of these decisions is very much a grey area because of the defect of institutionalization.Thus,it is very necessary to institutionalize these decisions in order to make them function continually.
