摘要
"难民与非法入境者"是困扰国际社会的一个重大问题,与其他国家面临困境不同的是,此类族群主要生活在中国边境地区。当前,在中国边境地区存在着三大类"难民与非法入境者"族群:越南难民、缅甸难民和朝鲜非法入境者。这些人生活在中国边境省份,都有非常鲜明的民族或者宗教特征,存在着一定程度的聚居性。尽管联合国难民署和中国政府做了多方面努力,由于资源和条件的限制,这些地区存在着人道主义危机,并引发了一系列社会问题。中国不仅存在着难民问题,也面临潜在的地缘政治危机所导致的更大的难民危机,这将对中国东北、西北和西南地区构成一定程度的地缘政治威胁。对于这类问题的主要对策,中国需要从立法、执行机构以及特殊区域建设等方面入手解决。在具体实践中,中国需要在确立难民跨境干预原则、设立境外难民援助原则、加强难民营文化干预等方面取得突破。
Refugees and illegal immigrants are a major problem that plagues the international community. Refugees and illegal immigrants who come to China mainly live in border areas and can be classified into three categories: Vietnamese refugees, Burmese refugees, and North Korean illegal immigrants. These people have very distinctive ethnic or religious characteristics and live together in China's border provinces. Despite the multifaceted efforts of the United Nations High Commissioner for Refugees and the Chinese Government, there have been humanitarian crises in these areas, which have led to a series of social problems and even black camps in refugee camps, due to lack of resources and conditions. China is facing not only a refugee problem, but also a potential geopolitical crisis caused by a greater refugee crisis, which will lead to a certain degree of geopolitical threats in Northeast China, northwest and southwest regions. This paper argues that China's main countermeasures to solve such problems are legislation, implementing agency, and special regional construction. In practice, China needs to make breakthroughs in these areas: first, the establishment of the principle of cross-border intervention in refugee affairs; second, the establishment of the principle of foreign aid for refugees; and third, the establishment of Confucius Institute in refugee camps.
