摘要
治安调解作为公安行政执法方式的一种,由于现阶段立法的不明确、适用过程中执法人员任意扩大或缩小适用范围、调解方式不当等情况的出现,使得治安调解带来的社会效应更加趋于复杂。除了治安调解在改善社会关系、节约司法资源、维护社会安定和谐的秩序等方面起到了正面作用外,我们还必须正视当前它所引起的一系列负面社会效应,如:侵害当事人的诉权、导致不公正的结果、影响现世纠纷解决的价值观、对法治建设和社会治安秩序也造成了一定的冲击。只有完善立法、提高办案民警调解素质和能力、坚持治安调解的原则、加强法治建设、创新新型治安调解方式,才能最大限度地发挥治安调解的正面社会效应,维护社会治安秩序。
Public security mediation legislation as one of the administrative law enforcenment of public security is not clear, the law enforcement officials ill-use in narrow way or expand the range or in improper situation, which make the public security mediation＇s social effect morecomplicated. In addition to the public security mediation plays a positive role in many aspects,such as the improvement of social relations, saving judicial resources, safeguard social stability and harmony, we also have to face up to the current series of negative social effect caused by it, such as the infringement litigation right of the parties, leads to the unfair result, influence the secular values, the construction of the rule of law and the social security order are all impacted. Only to perfect the legislation, improve the quality and ability of the police, sticks to the principle, strengthen the construction of the rule of law, innovate the way of the new public security mediation, the positive social effect of public security mediation can be maximize, then to uphold the society security.
