摘要
“讨债型”警情基于债务活动的存在而引发,接受和处置警情是公安机关履行社会治理职能的重要体现。该类警情表现为滥用私力救济、行为过激引发违法犯罪、为达讨债目的报假警求助、阻碍施工生产等情形。警情处置中因民警法律素养不高、警情初判不准、预判不足、固化证据不力、欠缺处置技巧、语言适用失范而影响处警效果。恪守处置原则,完善处置方式,准确判明违法犯罪,做好现场调解,及时固定证据,正确处理涉财争议,规范处警语言,提升处警能力是“讨债型”警情处置的基本路径。
The"debt collection"police situation is triggered by debt activities,and accepting and disposing of them is the function of public security organs to perform social governance.I t manifests itself in the abuse of private power relief,excessive behavior that triggers illegal crimes,reporting to the police for assistance for the purpose of debt collection,and obstructing construction and production.The police’s legal literacy,preliminary judgment,pre-judgment,solidification of evidence,handling skills,and language application affect the effect of police handling.Abide by the principle of disposal,improve disposal methods,accurately identify violations and crimes,do a good job of on-site mediation,fix evidence in time,correctly handle financial disputes,standardize police language,and improve police handling capabilities are the basic path of"debt collection"police handling.
