摘要
司法成本控制与法官的成本投入息息相关。社会发展多元化反向刺激了法官的职业化,最终与司法精英化、专业化的法治潮流背道而驰,因此以司法成本控制为导向的法官精英化改革势在必行。司法成本控制是理想和目的,法官精英化是方式和手段,精英化又以员额制为主要形式。通过阐释法官精英化面临的困境与挑战,探求改革的路径,以期建立一个良好的法治生态。
The control of judicial costs is one of the important goals of the reform of the judicial system, which is closely related to the cost input of the judges. The diversification of social development leads to an increase in the number of cases, which in turn requires more judges leading to the popularization of judges. This phenomenon does not meet the judicial elite and professional development direction, so the control of judicial cost under the background of the specialization reform is imperative for us. The control of judicial cost is ideal and purpose, the specialization of the judges is the way and means, and elite and the staff system is the main form for the reform. By explaining the plight and challenge of the specialization of the judges, we ex- plore the path of reform and look forward to the establishment of a good rule of law ecology.
