司法隐性知识如何传递——以法院师徒制法官培养模式的变革为切入点

How to Transfer Judicial Tacit Knowledge——With the Entry Point of the Change of the Judge Cultivation Mode of the Mentoring System in the Court

摘要 司法隐性知识广泛存在于法官司法裁判过程中,并发挥重要的作用。司法隐性知识弥散在经验中,需要个体通过审判经验的学习积累而获得。长期以来,我国法院系统司法隐性知识传递的一个重要方式是依托师徒制法官培养模式来进行的。随着制度、文化、关系3种法院治理资源的变化,师徒制在当前法官培养的实践中走向了边缘化,其局限性在现代性背景下也逐渐显露,司法隐性知识的有效传递面临挑战。法院应当以整体性视角生产、调配组织中的制度、文化以及关系资源,通过优化它们的分布、配置和个体获取方式,促进师徒制功能有效发挥,保障司法隐性知识的有效传递。 Judicial tacit knowledge widely exists in the process of the judicial adjudication of judges and plays an important role.Judicial tacit knowledge spreads in experiences and should be obtained by individuals through the study and accumulation of trial experience.In the long term,an important transferring method of the judicial tacit knowledge in the court system in China is the judge cultivation mode of the mentoring system.With the change of court governance resources of system,culture,and relationship,in the current judge cultivation practice,the mentoring system is marginalized.Its limitation gradually appeared under the modern background.The effective transferring of judicial tacit knowledge faces the challenge.The court should fully produce and allocate the system,culture,and relationship resources in the organization from the holistic perspective;and promote the effective exertion of the mentoring system function and guarantee the effective transferring of judicial tacit knowledge by optimizing their distribution,allocation,and acquisition method of individuals.
