摘要
历史能在多大程度上赋予统治以合法性,这一普遍问题在柏克"因袭"学说中有精妙回答。其精妙性有赖于"因袭"在普通法上的双重含义和英国法政传统的两种因袭主义所提供的空间。柏克之说是对二元因素的糅合。结合语境和文本,大致可识别出他为克服张力所采用的修辞手法。由此,他树立历史的权威,却否认历史可被用作否定当下的外在标尺;确认当下的权威,却否认当下可与历史决裂。其目的在于平衡道统与今王、自由与权威、革命与反革命。其根本教益是用时间的调和性驯化政治主体及其诉求的绝对性,使政治变得有弹性,使张力变得有意义。
To what extent can history give legitimacy to governance?A delicate answer to this universal question can be found in Edmund Burke's doctrine of'prescription'.The delicacy owes a lot to the double meanings of conventionalism in common law and the two kinds of conventionalism in English legal and political traditions.Burke's theory is a mixture of two factors.When combining context with text,it is easy to recognize the rhetorical devices he used to overcome tension.Thus,he set up the authority of'history',but denied that history can be used as the external ruler to erode the present authority;he endorses the present authority,but he denies that it can be separated with'history'.His purpose is to balance the orthodoxy and the present king,freedom and the authority,revolution and counter revolution.The fundamental lesson is that the political essence and its appeal are tamed by the coordination of time,so that politics becomes flexible and tension becomes meaningful.
