摘要
我国《基本医疗卫生法》已经被提上了立法日程,但立法过程中还有诸多理论问题亟待解决。相比于《基本医疗卫生法》等法名,《基本卫生法》或《卫生法》是更为科学而规范的名称。《基本医疗卫生法》的立法定位是承担着基本医疗服务保障功能的一部卫生基本法。作为我国卫生领域的基本法,《基本医疗卫生法》应当规定医疗保健基本制度、药品管理基本制度、公共卫生保障制度、卫生科技与卫生教育促进及规范基本制度。
The China＇ s Basic Medicine and Health Law has been put into the schedule of China＇ s legislators, while there are still many theoretical problems should be resolved during the legislation. Compared to the title of Basic Medicine and Health Law, the name of Basic Health Law or Health Law might be the more correct title. The Basic Medicine and Health Law should be the central law of Chinese health law system which assumes the duty of offering basic medical service. As the central law of Chinese system of health laws, the Basic Medicine and Health Law should stipulate several systems such as the elementary health care system, the fundamental drugs management system, the basic public health safeguard system and the essential system on health technology and health education.
